If there was the passcode lock would be useless, try backing it up and restoring it via itunes....

If the iPod is locked with a passcode and you do not know it, you'll need to connect the iPod to your iTunes library and restore it to factory settings. If iTunes still asks you for the passcode, connect the iPod in Recovery Mode.
