offshore is still way way way more safer. the US can grant itself to demand whatever it wants, that does not mean other countries have to comply to those demands. what that article says is that US Magistrate Judge James Frances in New York granted the government to make demands for information without warrants, that previously would've required warrants, which will affect servers and relay points whithin the US, however US Magistrate Judge James Frances in New York is only a US Magistrate, and does not now (nor will he ever) have the ability to dictate international law, or laws of any foreign entities.

left-leaning governments, such as the one in The Netherlands, will be under no obligation by international law to comply with US requests for information (the difference here being that previously, the US govt would require a warrant signed by a judge to even make a request, now they can make a request without a warrant, however these domestically-issued warrants only control what the US government can do as far as making these type of requests, and hold no jurisdiction over foreign entities to respond to these requests).

an even safer bet is many of the servers that are popular among the blackhat crowd in the Russian Federation or China.

one thing to be noted now, is that the US can spy on the outgoing and incoming traffic FROM overseas servers at domestic relay points, which in my opinion means that end-users in the US using foreign services should be taking more precaution in how they behave in this hobby... proxies/vpn/etc if you are going to be discussing certain topics, and common sense when it comes to making donations (it is even possible to use paypal without revealing your personal info or IP, be creative). that being said, the govt seems less concerned with this hobby and isn't the biggest threat, the biggest threat is civil suits from ekko*, and they are only getting their information from private investigators working within legal constraints.
