Defendant is involved in and/or is responsible for manufacturing, distributing, promoting, installing, and using pirate tools and software. Defendant's tools and software are primarily designed to, and do, allow end-users to circumvent the technological measures that Plaintiffs utilize to protect access to copyrighted works distributed by DISH Network. This circumvention occurs without authorization or permission from Plaintiffs.

Defendant used the moniker "Richiemiami" on satellite piracy websites, including without limitation, www . freefta.tv and www . ilinkforum.com. Defendant's posts indicate that he is the owner and operator of www . freefta.tv and www . ilinkforum.com.

Defendant creates and posts videos on www . YouTube.com that contain instructions on modifying and using unauthorized receivers and IKS to illegally receive and view DISH Network programming without authorization from or payment of a subscription fee to DISH Network. These videos show Defendant's unauthorized interception of DISH Network programming.

Thats in the OLD DAYS my freind, they dont need turncoats any more, they have public fourms like this one. In the past if you didnt know the secert handshake you werent in the club. With iks they now have a pass key to all the need info. Gee's tactics are very simple and clear. IKS/Public server and associated website are his main goal. Using Google and public forums are his avenue of investagation. There isnt a more cost effecient way to do it!

The double edged sord is IKS, and this is what the old hobby has been reduced to. Finding ways to do it quietly is the NOW!!!

richie was not a bad person. He just did not think when he should have. He and I had many conversations and through them he proved his knowledge of true FTA, he has a lot to learn, as do I and many others. His laziness was annoying and forgetfulness unbelievable. To tell me "I'll be over in 30 minutes" and 2 hours passes. this was the usual. Anyway, "richiemiami, when you coming over to put up the 1M dish you sold me as a 1.2M dish. I think if you could you might, but I have my doubts. Word on the street is you don't know how, by several people that you know. That's what they tell me. Big deal, who cares. Those that speak poorly of you, so you can of them.
I still have the dish, motor, LNB. mast, etc. are you up for some legit work?

The ilinkforum was a nice forum, almost directed at Ilink. It was very similar to any other forum, except richie ruled with an IRON FIST.

There was never a file for the receiver to communicate through the serial port. Unless the sorce code is released or someone writes a file it wont happen.. Chances of a com file are next to nothing.

On December 1, 2011, Judge Kenneth Ryskamp entered final judgment and a permanent injunction against Defendant Richard (RichieMiami) Schwartz and his websites freefta.tv and ilinkforum.com <http://ilinkforum.com/> . Schwartz and his sites were sued by DISH Network <http://www.dishnetwork.com/> and NagraStar in February of this year for claims under the Digital Millennium Copyright Act (DMCA), Federal Communications Act and Federal Wiretap Act based on their distribution of software files designed to facilitate the unauthorized interception of DISH Network programming. The consent judgment included findings that Defendants acknowledge the software files distributed on the websites were primarily designed to facilitate unauthorized access and included judgment in favor of DISH Network and NagraStar on each of their claims. The judgment permanently enjoins Schwartz from further conduct, including the future operation of any similar websites and ruled that any such future violations would result in $110,000 in statutory damages per act. NagraStar and DISH Network continue to investigate and take action against individuals and entities responsible for trying to circumvent the companies security system in order to gain unauthorized access to DISH Network programming.

He got off easy, much easier than all the others in most cases we read about or know about; yet still flaunts and disobeys court order by selling boxes. Hmm, my radar went off some at first site then and even more now.

He pays nothing as far as monetary damages with just a promise signed no doubt also agreed upon between him, his counsel and judge/pa. If someone can find the details openly and legally about this absolute plea bargain please post.

I know as fact as do a few of my colleagues "not engage in further conduct" is so vague and so non descriptive that it can have vastly different meaning from one person to the next.

There was never a file for the receiver to communicate through the serial port. Unless the sorce code is released or someone writes a file it wont happen.. Chances of a com file are next to nothing.

There has been work on another site that if someone assembles the bits and pieces has VS2000 Plat running IKS, so I am sure that a VS2000 Extreme could be made to work.

There were likely hundreds of demand letters sent out assuming there were probably hundreds of Dark Angel customers. The number of cases would be far less since some settle on the demand letter perfering to avoid court and being sued.

I do not think so. That's private if you settle out of court with the demand letter. One reason you do so is to avoid your name showing up in public in a court document. People have settled with demand letters in the past with DTV and it only got publicised with their nick not real name when the poster/defendant posted themselves that they decided to settle versus risking going to court.
