    Default Federal Court enters final judgment against NFPS end-user Alejandro Hernandez

    Federal Court enters final judgment against NFPS end-user Alejandro Hernandez, awards $10,000 in statutory penalties, and issues a permanent injunction

    On February 9, 2015 the United States District Court for the Central District of California granted DISH Network and NagraStar’s motion for final judgment against Alejandro Hernandez. Hernandez was sued by DISH Network and NagraStar for federal claims arising out of his subscription to the NFPS IKS service. The Court’s order includes a permanent injunction against Hernandez as well as an award of $10,000 in statutory damages (the maximum damages per violation) under the Electronics Communication Privacy Act and an additional $1,200 in costs and fees. DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.

    The Clerk having entered default against Defendant Alejandro Hernandez, and the Court having granted Plaintiffs’ motion for default judgment in favor of Plaintiffs and against Defendant, IT IS ORDERED AND ADJUDGED that judgment be entered against Hernandez and in favor of Plaintiffs for $10,000 in statutory damages and $1,200 in attorneys’ fees.     I,ll bet there wishing now they had paid the 3.500 or 5.000 dollars they were asking to settle out of court.....

    These folks may have listened to all the bad advise that was given saying they only go after suppliers and dealers ....
