This lawyer is a scumbag opportunist.
Instead of doing his own investigation and going after the distributors he waits for the ISP to do his dirty work to go after the lowly people who do the actual download.
ISP's are their own worst enemy in this instance
they all have a TOS or AUP that prohibits any illegal activity, they do this for various reasons but mostly to limit their liability, but the irony is, it forces them to enforce their own legal jargon if they are provided with proof that a particular account was used in a way that is against their TOS or AUP
the argument that they can't prove who actually committed the violation isn't relevant because if you read the TOS or AUP you will find that the person that holds the account is responsible for the actions of all users that they allow to use the system
