If you leave your keys in your car, in some states if the car is driven away by someone else it is not theft.

In some places you can get free legal aid. It costs little to go to court. It obviously can cost a lot to not bother to do so.

Personally I think if the car is taken without permission regardless if the keys were left its grand auto theft. being stupid and making easier does not in my opinion allowed someone to take someone's car without their authority. Now you might have a problem with your insurance company don't know.

First I am talking about end user Sat cases that we have as I assume you are. What I know is their programming is encrypted. What I know by law as far as the DMCA your circumventing their security encryption and receiving their copyrighted programming without making payment to them. RCA also talks about encrypted programming with no changes since 1991. I hardly think any court will say they have not taken required steps under the law.






In my opinion I strongly believe an end user would not be successful in saying I circumvented their security because I found a way to do it. Its like saying your defense in robbing the bank is you were able to by pass their security so tough beans.


So is it your opinion an end user would be successful with a defense their security encryption was not good enough therefore I am allowed to circumvent it and am not liable. ?

No, it would be a long shot at best. My advice has always been, and still is to settle. I was just pointing out this angle has not been tried yet. The EFF was successful in assisting for a protection order for purchasers of Coolsat STB's. Effectively quashing 17 subpoenas to dealers. The basis was that there was a legitimate FTA use for the units, and in no way would finding the identities of purchasers assist the plaintiffs in proving the primary use was for circumventing Plaintiffs encryption system. It would not apply to PayPal in these cases because there is no legitimate reason to purchase these codes. Add to that, they have forum posts, PM's, Emails, IP's etc. I was just thinking outside the box. You have to admit though, IKS has been around seemingly forever, if I was a shareholder, I would be demanding that the provider correct the loop holes, and stop bleeding profits from the bottom line.

No it has not been tried. I don't think anything much has been tried period. Probably the best I bought the sub but never decoded although a long shot too


If you try that and you have a dish or made posts than your pretty well toast. Should be tried if your have no skeltons and don't mind defending yourself and rolling the dice.


In the end settling is the safest way and probably least expensive. Some will holler weakness and I would not cave in but their ass is not on the line.



I agree about it being too long and think a company like Comcast could try something similar to what Videotron did.

I would imagine they have been weighing the cost versus the benefit of killing piracy, for a long time now.

Either way it will affect their bottom line. money spent chasing pirates or swap out all their gear ...

The doc shows that defendant never showed up in court. Pretty much made the result a requirement. If he had bothered to appear, odds are the results would have been different.

*Choice has used the same system from the beginning as far as I know. They never had a piracy problem.

End-users are only seeing the $10,000 default judgement because they just ignore the letters and think that it will just go away. I really do think that if someone were to actually respond, they could potentially settle for less.

I tend to agree with this. They have your PayPal info which means they can run a credit check and find out all you have (or don't have) and even see your home on Google Earth.

I'm guessing they can't find NFPS owners - but they have been able to find some dealers and make them rollover.
I doubt that the guys that actually run the NFPS servers have that many end users paying them - maybe they just sell their push to other smaller dealers and those are the guys that you have to worry about getting caught and rolling over on their clients.
I am sure the Providers would love to get their hands on the server operators but that may be easier said than done.
I have not heard of any cases where they are using IP addresses to prove that clients were connecting to a server and actually watching TV - it seems they are just going after the guys that are buying and not protecting themselves and being safe when they purchase.
